We reserve the right to modify or discontinue any feature at any time.

4. User Responsibilities

Users agree to:

  • Use the platform legally.
  • Obtain recipient consent before sending campaigns where required by applicable law.
  • Keep account credentials secure.
  • Maintain accurate subscriber information.
  • Respect applicable privacy and anti-spam laws.

5. Prohibited Activities

Users must NOT:

  • Send spam.
  • Send phishing emails.
  • Send malware.
  • Send fraudulent messages.
  • Promote illegal products.
  • Send hate speech.
  • Send adult content where prohibited.
  • Send misleading advertisements.
  • Use purchased or scraped email lists where prohibited by law or platform policy.
  • Forge email headers.
  • Impersonate another person or organization.

Violation may result in immediate suspension.

6. Email Marketing Policy

Users must ensure:

  • Subscribers have provided permission where required.
  • Every campaign contains an unsubscribe option.
  • Sender identity is accurate.
  • Subject lines are not misleading.
  • Marketing complies with applicable regulations (such as CAN-SPAM, GDPR, or local laws where relevant).

7. WhatsApp Messaging Policy

Users agree that:

  • Messages will be sent only through approved WhatsApp Business channels.
  • Users are responsible for template approvals.
  • Promotional messages must comply with WhatsApp Business policies.
  • Platform is not responsible for Meta policy violations caused by customer content.

8. Customer Data

Users retain ownership of their:

  • Contacts
  • Campaigns
  • Templates
  • Uploaded files

We process customer data only to provide our services.

9. Privacy

We respect customer privacy. Please review our Privacy Policy regarding:

  • Data collection
  • Cookies
  • Analytics
  • Third-party integrations
  • Data retention

10. Payment Terms

  • Subscription fees are billed in advance.
  • Prices may change with prior notice.
  • Taxes are extra where applicable.
  • Failed payments may suspend services.

11. Refund Policy

Unless required by law:

  • Subscription payments are non-refundable.
  • Unused credits are non-refundable.
  • Promotional purchases cannot be exchanged for cash.

12. Fair Usage Policy

To maintain service quality, excessive usage may be limited. Examples include:

  • Bulk API abuse

  • Unusual sending patterns

13. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Maintenance windows and third-party outages may temporarily affect service.

  • Microsoft
  • Zoho
  • Payment gateways

We are not responsible for downtime or policy changes made by these providers.

15. Intellectual Property

All software, branding, logos, templates, and source code belong to the company unless otherwise stated.

16. Account Suspension

We may suspend or terminate accounts for:

  • Spam complaints
  • High bounce rates
  • Abuse reports
  • Fraud
  • Chargebacks
  • Illegal activity
  • Violation of these Terms

17. Limitation of Liability

We are not liable for:

  • Delivery failures
  • ISP blocking
  • SMTP rejection
  • Meta delivery decisions
  • Email spam filtering
  • Customer content
  • Business losses
  • Lost profits
  • Data loss caused by third-party services

18. Indemnification

Users agree to indemnify and hold the company harmless against claims arising from misuse of the platform or violations of applicable law.

19. Force Majeure

We are not responsible for delays caused by:

  • Internet outages
  • Government actions
  • Natural disasters
  • Cyber attacks
  • Cloud provider outages

20. Changes to Terms

We may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
